This End User License Agreement (EULA) is an agreement between you, whether an individual or an organisation (the User), and the rightholder, the Vibe Chess project (the Rightholder), governing your use of the Vibe Chess software.
By opening, installing on a device or otherwise using the Vibe Chess software, you accept the terms of this agreement. If you do not agree with them, do not use the software.
How we handle data is described in the privacy policy, and the rules of conduct in the service are set out in the terms of use.
This agreement covers the software that the Rightholder distributes under the Vibe Chess name (together, the Software):
The agreement is concluded when you start using the Software and remains in force for as long as you use it, within the term of the exclusive right.
The Rightholder grants you a free, simple (non-exclusive) licence to use the Software. The licence is non-transferable and may not be sublicensed; it is worldwide and lasts for the term of this agreement.
The licence entitles you to use the Software for its intended purpose:
Full access to the features opens after you sign in with Telegram or VK ID. No keys, activation codes or payment are required.
You may not, and may not allow others to:
An organiser may charge for their own event, but not for access to the Software itself: it is free for every participant.
The Software is a result of intellectual activity. The exclusive rights to it belong to the Rightholder and are protected by the copyright law of the Russian Federation and by international treaties. This agreement grants you no rights in the Software other than the limited right of use described above. The Vibe Chess name and logo are designations of the Rightholder.
The source code of the Software and the algorithms by which it works, including how moves are processed, are the Rightholder's trade secret. Using them in breach of this agreement is grounds for terminating your licence.
The Software includes open-source components by other authors. They are governed by their own licences, and where a component's licence conflicts with this agreement, the component's licence prevails:
Telegram and VK are independent services: when you sign in through them, their own terms apply.
The Software is provided free of charge. If paid features are ever introduced, their terms and prices will be published in advance, and you will be able to use them only by your own separate decision.
The Software updates itself: the web version and the mini app always open in their current version, and you do not need to install updates. The Rightholder may add, change and remove features.
The Rightholder fixes reported bugs as quickly as reasonably possible. No exact timeframe can be promised: the Software works together with Telegram, your browser, operating system and device, none of which the Rightholder controls.
For help and questions, use the /support command in the bot or send us a message on Telegram: message us.
Breach of this agreement entails liability under the law of the Russian Federation.
To the extent permitted by law, the Rightholder is not liable for indirect losses, lost profits, loss of data or any other damage arising from the use of the Software or the inability to use it.
Access to the Software is protected by your Telegram or VK account, and keeping that account secure is your responsibility. Actions taken from your account are deemed to be yours until you report unauthorised access. If you suspect that someone else is using your account, message us straight away.
The Software is provided "as is". The Rightholder does not warrant that it will meet your expectations, be fit for a particular purpose or work without interruptions or errors.
The Rightholder does not review in advance the information users post in the Software - event names and descriptions, names, photos, results - and is not responsible for it; responsibility lies with whoever posted it.
Data is stored on the Rightholder's servers and backed up regularly, but the Rightholder cannot guarantee that information will never be lost.
The Rightholder is the Vibe Chess project: an over-the-board chess club and an app for running chess tournaments.
